The regular meeting of the Groveland Town Board was held on Thursday March 11, 2010 at the Town Hall.

Present: James C. Merrick, Supervisor; Burt Lyon, Bill Carman, John Driscoll, Craig Phelps, Councilman; Greg Adamson, Highway Superintendent

Absent: None

Other Attendees: None

 Supervisor handed out the monthly financial reports along with the Livingston County Board of Supervisor minutes.

  • Time sheets due in at the end of March for NYS Retirement credit

Supervisor called the meeting to order @ 7:55 p.m.

Motion by Councilman Carman, seconded by Councilman Lyon the audited bills be paid. General Fund vouchers numbered 47-79 for $7,246.76; MVP voucher number 51&52 for $10,333.60; Highway Fund vouchers numbered 53- 77 for $20,320.82; Conesus Lake District voucher numbered 1 for $2,555.71. Motion carried unanimously.

Motion by Councilman Lyon seconded by Councilman Phelps to approve the minutes of February 11, 2010 as written. Motion carried unanimously.

Motion by Councilman Phelps, seconded by Councilman Carman to accept the monthly financial reports as submitted. Motion carried unanimously.

 

Old/New Business:

 

HIGHWAY- Greg reported that he had received 1 bid for the Truck Box in the amount of $3450 from Robert Mahany of Dansville. We paid $1,100 and could try to get more at an auction, but could be a gamble and are satisfied with bid price. Motion by Councilman Carman, seconded by Councilman Phelps to accept the bid for $3450. Motion carried unanimously.

Greg also reported he has received 5 applications for mowing and will be reviewing them next week and making a decision shortly after.

Greg has received a tax notice from Wayland for the gravel pit that shows the assessment going up $20,000 but showing a decrease in estimated taxes of $1000.

DEC called to schedule a Petroleum inspection on 3/23/10; Greg does not anticipate any problems.

 

HAWTHORN HILLS ROAD DEDICATION – Greg provided information on the approved plans and how the roads have been built so far. To date the roads do not meet the approved plans in dimensions. Motion by Councilman Lyon, seconded by Councilman Driscoll to take dedication once Mr. Stewart constructs the roads to the approved plans with topcoat, plus adding a better base, binder & topcoat to the turnarounds with Greg’s specifications. Motion carried unanimously. Greg will meet with Attorney Meyer to draft the letter to Mr. Stewart and to copy in residents, LeMoyne & Provino.

 

PLANNING BOARD ALTERNATE – a letter was received from Roxanne Adamson requesting to be reinstated to the planning board as an alternate member. Motion by Councilman Lyon, seconded by Councilman Driscoll to appoint Roxanne as an alternate member to the Planning Board. Motion carried unanimously. A letter will be sent to give the training requirements.

 

AUDIT OF ANNUAL REPORTS - RESOLUTION 1-2010

 WHEREAS, the Town Board has met at the time and place at its regular meeting, to review the 2009 annual reports submitted by the Justice Court office, Town Clerk, and the Code Enforcement office. At which these reports were previously submitted at the regular Town Board meeting of February 11, 2010 to take home for review, now therefore be it;

 

RESOLVED this Town Board does hereby accept such Annual Reports that reflects with the Town Annual Report of the Town Accounts office from Baldwin Business; fiscal year ending December 31, 2009 and that such 2009 annual reports be adopted, by this Board, be entered in the minutes of the proceedings of this Town Board.

 

The question of the adoption of the foregoing RESOLUTION was put into vote. Motion by Councilman Carman and seconded by Councilman Lyon and the results were carried unanimously.

 

BAN – RESOLUTION 2-2010 - Supervisor is renewing the Conesus Lake Water District., after paying off $36,940 plus $20,280.06 in interest.

WHEREAS, the Town of Groveland term of the B.A.N for the Conesus Lake Water District is due for renewal.

 WHEREAS, the Supervisor has asked the Board to renew the B.A.N for the Water District.

 NOW, BE IT RESOLVED THAT,

 The Board will hold a B.A.N. in the amount of $627,980 @ 2.95% interest for the purpose of the Conesus Lake Water District.

 The question of the adoption of the foregoing RESOLUTION AND ORDER was duly put into vote on motion of Councilman Driscoll and seconded by Councilman Lyon and the results were carried unanimously.

 RECORD DISPOSAL – Town Clerk presented a list of items that have reached their retention schedule and are ready to be destroyed. Board reviewed and had no objections for the destruction of the list provided.

ZONING LAW DRAFT – Board discussion: Since the hand out of the draft law last month, Councilman Lyon suggests we move forward with the review and try to pass it since the Farmland Protection Plan is near completion and may require changes with our zoning. There is a consideration of breaking up the AR district.

 

Councilman Carman & Lyon gave an update and overview of the Farmland Protection Plan. CHA, LLC is nearly ready to hold a public hearing to unveil the Draft plan. Motion by Councilman, seconded Councilman Phelps to set a tentative public hearing date on April 8, 2010 @ 8:00 p.m. pending CHA verifies they are ready to go.

 

JUSTICE TABLE REQUEST – Supervisor read a letter from Justice Love requesting to purchase 2 wooden tables to be used for jury trials. The board did review and discuss your request and have decided to turn down the request. The purchase is considered equipment and no money has been allocated in their budget for equipment. There are white tables or the gray tables available. The gray have in the past been utilized for the jury trials, and they felt the purchase is excessive for something that may occur maybe once a year when we already have tables in good working condition. Greg will look into the surplus. Supervisor will draft a response letter.

Communications:

Supervisor Merrick stated he had Baldwin set up the Highway HRA account for $600 a year. All other company fees are much more and only offer a no cost if the health insurance policy is a high deductible plan.

Councilman Lyon has recently heard about a program called “Right to Farm Community,” and thinks Groveland should consider looking into it further. It may go hand in hand with the Farmland Protection Plan. He asked the Town clerk to get more information to bring at the next meeting.

Town Clerk reported that she attended a meeting at the county regards the 2010 census and the importance to get the word out. The 2000 census listed Groveland as a low mail response, which could effect our funding as well as the added cost of the enumerators to canvass the area. Will check with the Fire Department if they would like to host a public open forum.

Town Clerk informed everyone that Earth Day is coming up and she has nomination applications if anyone is interested.

Town Clerk reported that the taxes have been coming in very steady and no increase in unpaid taxes this year.

Motion by Councilman Lyon, seconded by Councilman Carman to adjourn the meeting. Motion carried unanimously. Meeting Adjourned at 9:03 p.m. The next regular meeting is on Thursday April 8, 2010 at the town hall.
