The regular meeting of the Groveland Town Board was held on Thursday April 8, 2010 at the Town Hall.

Present: James C. Merrick, Supervisor; Burt Lyon, Bill Carman, John Driscoll, Craig Phelps, Councilman; Greg Adamson, Highway Superintendent

Absent: None

Other Attendees: Tim Sullivan

 Supervisor handed out the monthly financial reports along with the Livingston County Board of Supervisor minutes.

  • Supervisor called the meeting to order @ 7:58 p.m.

Motion by Councilman Carman, seconded by Councilman Phelps the audited bills be paid. General Fund vouchers numbered 80-107 for $8,333.62; Highway Fund vouchers numbered 78- 105 for $34,354.34; Cemetery District voucher numbered 2-3 for $223.24; Fire & Ambulance vouchers numbered 1-2 for $85,532. Motion carried unanimously.

Motion by Councilman Lyon seconded by Councilman Phelps to approve the minutes of March 11, 2010 as written. Motion carried unanimously.

Motion by Councilman Lyon, seconded by Councilman Driscoll to accept the monthly financial reports as submitted. Motion carried unanimously.

 

Old/New Business:

 

HIGHWAY- Greg reported that all the information regarding the Hawthorn Hills Road dedication was given to Attorney Meyer who has issued a letter to Mr. Stewart. Supervisor Merrick had spoken with Mr. Stewart who thinks he seemed receptive to the letter.

Greg also stated that the on-going matter with Mr. Soscia that dates back to 1998 and the drainage off his property has been addressed with Attorney Meyer who has delivered all the information to Soscia’s attorney Robert Presutti, which states the town is willing to relocate the culvert pipe and how the runoff drains.

The inspector came and inspected the fuel tanks and did have some concerns that Greg addressed to avoid possible $37,500 per day fines. The inspector found the inside tanks utilized for used oil is aluminum even though previous 2 inspectors stated they were steel. Some color coding of letters were also updated. The rules now require us to document each time we inspect our tanks and keep a log.

Councilman Driscoll asked if our tanks are in containment – Greg stated that the diesel and gasoline tanks are and that the inspector did like that feature.

Greg also reported that the crushers are working at the gravel pit. Greg will be ordering trees next week that will be utilized on the portion of Barber Hill Road that is being top coated this year.

 

ZONING LAW UPDATE PROPOSAL – Board members were given the proposed updates in February. Councilman Lyon suggested that the board look at what we do with the Ag District within the Farmland Protection Plan before getting to deep within the Zoning Law updates. All agreed to hold the Zoning updates until June pending the outcome of the Farmland Protection Plan approval.

 Tim Sullivan – inquired if there is going to be a comprehensive plan? He thinks there should be a comprehensive plan before zoning updates.

The board stated yes, eventually. We will work with the Farmland plan and utilize it to develop a comprehensive plan. Supervisor Merrick also stated that we are working with what we have and our limited funding.

 

NYS RETIREMENT CREDIT HOURS-   Hours submitted from all but Jenean Love and Karol Thomas.  Town Clerk stated that Karol was not asked to track her information. Town board suggested before making the final decision that Karol Thomas be asked to submit her timesheets before the May meeting. All agreed. Councilman Phelps requested to have enrollment forms mailed to him.

 

COURT CLERK CLARIFICATION – board reviewed a letter submitted by Court Clerk, Kathy Watkins, who would like the board to consider her previous service to be combined with current service since the Vacation Policy was not clear on consecutive service in the 2008 policy.  Motion by Councilman Lyon, seconded by Councilman Phelps the board agree to her request because of Kathy’s previous service and the ambiguity of the 2008 policy that will combine Kathy’s years of service while factoring eligibility of vacation time.  Motion carried unanimously. Supervisor will send a response.

FARMLAND PROTECTION PROPOSED PLAN – the public hearing was tentatively scheduled for tonight but CHA, LLC needed to postpone in order to attend other meetings that may help with the final drafting of the plan. Motion by Councilman Lyon, seconded by Councilman Phelps to set May 13, 2010 @ 8:00 p.m. for a public hearing to present the draft plan. Motion carried unanimously.

RIGHT TO FARM – Councilman Lyon gave an overview of the benefits of declaring a Right to Farm policy. The NYS AG & Markets law was handed out. A sample model law from Yates County is available to view. Councilman Lyon suggested the board review the statue law and model law and discuss at the next meeting. All agreed. Town Clerk will email a copy of the model law and check with the County Planning Department for other samples.

GROVELAND FIRE DEPARTMENT ANNUAL REPORT – copies of the department annual report was handed out to take home for review to discuss audit at the next meeting.

Communications:

Supervisor Merrick passed around a letter from NYS Laborers Organizing Fund that looking for us to partner up with them.

Town Clerk reported the 2010 tax collection is closed out and settled with the county. We closed with 58 unpaid tax bills, which is an all time low for Groveland. Also, the County has advertised the upcoming list of foreclosures that shows 3 parcels for Groveland.

Town Clerk also reported that she and her deputy will be attending a training seminar on April 26 & 27th; Betty Sanderson will be in the office during that time.

Supervisor reported that the jail is going well and within budget.

Councilman Lyon inquired if the employee handbook is with the town attorney, Supervisor stated no and that Kevin Niedermaier still needs to get it to him. Kevin has had some personal business that has prevented him to moving it forward. He will get with him and work on getting it to the attorney.

Motion by Councilman Phelps, seconded by Councilman Lyon to adjourn the meeting. Motion carried unanimously. Meeting Adjourned at 8:50 p.m. The next regular meeting is on Thursday May 13, 2010 at the town hall.
