The regular meeting of the Groveland Town Board was held on Thursday June 11, 2009 at the Town Hall.

Present: James C. Merrick, Supervisor; Burt Lyon, Bill Carman, Craig Phelps, Councilman; Greg Adamson, Highway Superintendent

Absent: Kevin Niedermaier, Councilman

Other Attendees: Steve Willison, Tim Sullivan

Town Clerk handed out the monthly clerk report.

 Supervisor handed out the monthly financial report along with the Livingston County Board of Supervisor minutes.

 Supervisor called the meeting to order @ 7:57 p.m.

Motion by Carman, seconded by Phelps the audited bills be paid. General Fund vouchers numbered 146-179 for $14,016.47; Cemetery Fund vouchers numbered 4-5 for $286.44; Fire & Ambulance voucher number 3 for $6,000; Conesus Lake Water Fund vouchers numbered 2-3 for $284.95; Preferred Care voucher number 143 for $4,340.16; Highway Fund vouchers numbered 144-174 for $19,476.18. Motion carried unanimously.

Motion by Phelps, seconded by Carman to approve the minutes of the regular meeting held on May 14, 2009 with clerical corrections. Motion carried unanimously.

Motion by Phelps, seconded by Lyon to accept the monthly financial reports submitted. Motion carried unanimously.

 

Old/New Business:

 

REZONING 3.5/3.6 PUBLIC HEARING – public hearing notice read and clarified that 3.5/3.6 are numbered for updated zoning laws and if approved tonight would reflect in current zoning as Section 32 & Section 33. Supervisor opened the public hearing at 8:00 p.m. Chairman of the ZBA, Steve Willison gave a recap of the recent changes that were based on Mr. Stewart’s concerns at the previous public hearing.

Tim Sullivan wanted to comment but did state that is not directly related to the topic, asked Phelps to clarify his statement made in the past “residential property cost the town money, when his property is close to a ½ million dollars and provides his share of taxes and wanted to know where he got the information and why he believes this.”

 

Phelps stated he has read this several times, but would Google why, but stated his statements were not meant to be specific to Groveland only, but that commercial property gives a better tax base overall.

Motion by Lyon to accept 3.5 (Section 32 of current zoning) as presented, seconded by Phelps. Motion carried unanimously.

Motion by Lyon to accept 3.6 (Section 33 of current zoning) as presented, seconded by Carman. Motion carried unanimously.

 

HIGHWAY REPORT – Greg reported that his crew is currently working with the county highway on Groveland Road. Stumps have been removed on Barber Hill Road.

He has hired Art Hendricks to do roadside mowing and Josh Adamson to do mowing at Lake View Cemetery. Matt Thompson was let go because he did not have the hours to put into it.

Greg reported that DEC is back in the area spraying for Hogweed and given contact information for new sightings of Hogweed.

Greg reported that he has received another letter from Pete Soscia stating he will be grading his property for building improvements and asking the town to change the course of drainage. Greg feels an easement would benefit the ongoing drainage concerns even though this was a preexisting drainage prior to Soscia owning the property. Greg, has forwarded a copy of the letter to Attorney Meyer too handle. Supervisor stated he will follow it up with Randy to make sure this gets addressed.

 

Greg reported he has received a complaint letter from a resident from Cottonwood Point wanting the town to update and fix the road. Greg stated that he contacted her and stated it is privately owned with an Association. Greg will follow-up his response in writing.

 

Cemetery Regulations – Greg has checked with other cemetery organizations and found that they have a limit of 2 cremations per lot and no one has a policy of residency preference.

 

FARMLAND PROTECTION GRANT – Clough Harbour Association, LLC (CHA) proposal was discussed. Supervisor gave a brief update of the meeting he had with CHA to make sure we would be able to get both a Farmland Plan and a Comprehensive Plan. In the proposal they are able to do both for the approved grant funding of $25,000. They recommended preparing one packet as opposed to two separate plans.

Motion by Lyon, seconded by Phelps to accept the CHA proposal as written. CHA will be at the next meeting of July 16th with a list of questions for interviews of all AG-2 owners/users. Phelps did get a letter out to all AG-2 owners/users to recruit an advisory committee and responses are due back June 30th to the Town Clerk. Board will make final selections at the next meeting.

 

ALARM SYSTEM – Supervisor has had numerous complaints that the alarm system was not armed when staff would enter the building. He asked the Town Clerk to get a report and verify the system is working properly. The report included all of May and part of June and shows the system operating correctly, but shows a pattern of one justice not rearming when leaving the building. He will send a letter hoping to rectify the problem.

 

Communication:

 

Supervisor reported that he will be having knee replacement on June 25th and will be out of the offices for 2-3 weeks but will work from home.

Supervisor received a letter stating we were not awarded our request for funding for the Ambuscade Park, but will reapply when offered again.

Supervisor passed around a list of the county property foreclosures to be auctioned off in the near future.

Supervisor passed around a report issued by NYS Retirement that states requirements are do to change and doesn’t look like it will be beneficial for smaller municipalities. This may require an updated resolution for credited hours.

Supervisor reported that the county has updated its purchasing policy and that we may want to consider updating ours.

Town Clerk reported that a Public Assistance Workshop is being held at the County Emergency Management Training grounds on 6/25/09 and has limited seats. Burt Lyon, Greg Adamson will attend and Ron Maxwell should attend if he is not through Geneseo.

 

Motion by Carman, seconded by Phelps to adjourn the meeting. Meeting adjourned at 8:50 p.m. The next regular meeting is on Thursday July 16, 2009 in the town hall.
